The club say they are claiming for the loss of their league position bonus for the 2006-07 season when they finished 16th, a place behind The Hammers.
Fulham are claiming that the Hammers benefited unfairly from goals scored by Tevez and that they have missed out on merit payment's of around half-a-million pounds.
The Hammers have already reached an out-of-court settlement believed to be around £15million with Sheffield United who were relegated from the Premier League that season.
